A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to face human smuggling allegations, he was detained in immigration detention.
In her order, the judge pointed out that the authorities lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
